What Are Illinois Specialty Courts?

Illinois specialty courts are also called therapeutic or problem-solving courts (PSC); they provide a different method of resolving specific cases relating to certain types of offenders in the state. These courts offer specific resolution techniques to persons who suffer from certain behavioral health issues. Specialty courts cater to matters including, but not limited to, drugs and substance abuse, veterans, mental health, and DUI. The courts aim to achieve and maintain permanent recovery for low-level criminal offenders.

Drug Court

An Illinois drug court seeks to help low-level offenders with successful rehabilitation from substance abuse. Illinois drug courts seek to reduce recidivism through supervised treatment, mandatory and periodic drug testing, general community supervision, and other rehabilitation efforts.

Mental Health Court

Mental health courts help persons with mental illnesses, looking to solve a problem, rather than a punitive pronouncement available with a traditional court. Offenders are admitted after mental health assessments and participate in a treatment course carefully created by mental health professionals and other qualified court personnel.

Veterans Court

Illinois Veterans Courts seek to help veterans manage the effects of their service in the armed forces. Recurring effects currently being managed by veterans courts in the state include traumatic brain injury, depression, substance abuse, alcohol addiction, and post-traumatic stress disorder.

 

Specialty courts provide an infusion of efforts from the state’s justice professionals, with a general therapeutic approach from community treatment providers. The methods also ensure that new and carefully created programs are created to tackle cases with unique features.

 

An Illinois specialty court typically has a selected judge that governs the court’s activities, with assistance from several staff members. The staff include, but are not limited to, the following:

  • Prosecutor
  • The public defender or defense counsel
  • Probation officer(s)
  • Local PSC coordinator
  • Licensed treatment provider(s)

The problem-solving courts (PSC) may also allow a client’s private counsel to sit on selected staff meetings. However, this is only allowed when the discussion is about a case that directly involves the client.

 

Matters to be resolved at a problem-solving court go through carefully curated screening processes before the court hears them. Regardless of this meticulous process, the general court procedure that governs the hearing is not as formal as other courts.

Specialty courts are also consistently reviewing requirements and the application of sanctions. Also, the courts always modify the several incentives and therapeutic measures it employs to treat the behavioral issues under its jurisdiction. These courts also use trained and multidisciplinary teams to ensure that their pronouncements are in the best interest of these parties.

Illinois specialty courts are under the supervisory and administrative authority of the Illinois Supreme Court. However, the uniform standards and framework that govern the courts also involve the Administrative Office of the Illinois Courts and the Special Supreme Court Advisory Committee for Justice and Mental Health Planning.
