Kendall County Arrest Records

In Kendall County, an officer can conduct an arrest upon witnessing a crime. An arrest may also be made if the officer has reasonable grounds that a person committed a crime or if there is an active warrant for the person’s arrest. Arrested persons are taken into custody to be questioned, charged, released, or booked into a detention facility following state laws. The arresting body then records information on the arrest, which may also be collected by the detention facility during booking.

Arrested persons in the county are usually booked into the Kendall County Jail operated by the Sheriff’s Office Corrections Division. Hence, Kendall County arrest records are obtainable from the arrested body or contained within inmate records maintained by the Sheriff’s Office. Other sources of arrest information may include Kendall County court records, criminal records, or sex offender registries.

Are Arrest Records Public in Kendall County?

Arrest records in Kendall County are mostly public and are in line with the Illinois Freedom of Information Act (FOIA). Under this Act, individuals can access arrest reports maintained by state or local law enforcement agencies, excluding juvenile records, personal identifying data on victims and confidential sources, or information that an agency may withhold if disclosure would interfere with proceedings or endanger an officer's or individual's safety. Additionally, persons incarcerated in a state or county jail are exempted from accessing arrest and booking records unless the record pertains to the inmate’s ongoing or potential case.

Despite exemptions, criminal justice agencies can redact the confidential details from copies provided to the public, or an individual may be granted exclusive access to certain exempted documents by law or court order.

What Do Public Arrest Records Contain?

Following state laws, public information contained in Kendall County arrest records includes:

  • Arrestee’s name, age, and other demographics
  • Mugshot or photograph
  • Charges or offense description
  • Arrest location and time
  • Name of arresting body
  • Housing facility or booking details
  • Discharge, release, bond, or transfer details (if any)

Other related arrest information like physical description, court disposition status, sentence information, and parole details may also be publicly available.

Kendall County Arrest Records Vs. Criminal Records

While Kendall County arrest records and criminal records are official documents from criminal justice agencies, each record provides a different range of information. The major difference between the information contained in both records is that while arrest details are included in criminal conviction records, conviction details are not typically found in arrest records.

This is because criminal records provide a comprehensive summary of an individual’s criminal history, whereas arrest records cover circumstances around an arrest event. As such, arrest records cannot be an adequate substitute for criminal records.

Nevertheless, both arrest and criminal records provide similar information on the offender, offense, and primary charges.

How Long Do Arrests Stay on Your Record?

As per state laws, an arrest shall remain in an individual’s record forever unless the arrest qualifies for automatic expungement. The Illinois State Police (ISP) and other law enforcement agencies in the state automatically remove arrest information on the following juvenile and minor cannabis offenses from record within specific timelines:

  • Minor cannabis offenses with no charges or convictions (dismissed or acquitted) if arrests occurred on or before June 25, 2019.
  • Juvenile offenses without a filed petition for delinquency if arrests occurred on or after January 1, 2015.
  • Minor cannabis convictions granted a Gubernatorial Pardon.

However, despite the automatic expungement, related court records may remain public unless persons successfully petition the court for expungement or sealing.

Expunge Kendall County Arrest Records

Illinois expungement laws allow persons to seal arrest records from public access or completely remove the incident from one’s record. In some cases, law enforcement agencies can expunge records automatically after reviewing if the record meets legal requirements, such as:

  • Juvenile offenses with no filed delinquency if arrests occurred on or after January 1, 2015, to be removed
  • Minor cannabis convictions granted a Gubernatorial Pardon
  • Minor cannabis offenses with no charges or convictions (dismissed or acquitted) if arrests occurred on or before June 25, 2019.
  • Non-conviction minor cannabis offense with arrests before January 1, 2000, to be removed by January 1, 2025
  • Non-conviction minor cannabis offense with arrests between January 1, 2000, and January 1, 2013, to be removed by January 1, 2023
  • Non-conviction minor cannabis offense with arrests between January 1, 2013, and June 25, 2019, to be removed by January 1, 2021.

If a record is eligible for automatic expungement but is still publicly available, the record subject may fill the appropriate expungement forms and file at the county’s Circuit Court. Individuals can also petition to seal or expunge the following eligible adult misdemeanor or felony convictions and their related arrest information:

  • No-conviction arrests and charges
  • No-charge traffic offenses
  • Criminal charges or arrests resulting from a case of identity theft
  • Eligible misdemeanors or felony convictions under the Cannabis Control Act
  • Certain non-violent misdemeanors or felony convictions after at least three years of completing sentences
  • Pardoned, vacated, or reversed felony or misdemeanor convictions
  • Class 4 felony prostitution convictions after an applicable waiting period
  • Certain eligible probation sentences.

To apply for expunction, record subjects should file a Motion to Vacate and Expunge in the Circuit Court in person, through a personal attorney, or through the State's Attorney (cannabis expungements). Note that the court may charge a fee to file this motion. Additionally, waiting periods and other specific time parameters must be satisfied before the expungement can happen.
